Terms of Use
These terms are an agreement between you and Eureka Software Factory ("we", "us") about your use of the Chou app and related services. By creating an account or using Chou, you agree to them. If you don't agree, don't use the app. Our Privacy Policy explains how we handle your data.
1. Eligibility and your account
You must be at least 13 years old (16 in the EEA and UK, or older where local law requires) to use Chou. You are responsible for keeping your sign-in details secure and for activity on your account. Give accurate information when you sign up.
2. Not medical advice
Chou is a food and symptom journal for general information. It is not a medical device and does not provide medical advice, diagnosis or treatment. Patterns between foods and symptoms are statistical observations from your own entries and do not prove cause. Do not rely on Chou for allergy, intolerance or medical decisions, and do not delay seeking professional advice because of something in the app. In an emergency, contact your local emergency number.
3. AI estimates may be wrong
Chou uses AI models to identify foods, estimate portions and nutrition values, and write chat replies. Nutrition values are AI estimates, not values from a nutrition database. These results are estimates and can be incomplete or wrong, for example a missed ingredient, a wrong portion size or wrong nutrition values. Review and correct entries before relying on them. Chat replies may be inaccurate even when they sound confident.
4. Acceptable use
You agree not to:
- upload content that is illegal, that you don't have the right to share, or that contains images of other people without their permission;
- use the app to harass anyone or to generate harmful content;
- try to access other users' data, or probe, overload or disrupt the service;
- get around daily limits or other usage limits, including by creating multiple accounts;
- use automated means to access the service, or resell or use it to build a competing service;
- reverse engineer the app except where the law allows it.
We apply daily limits on photo analyses, chat messages and nutrition estimates, and may change them.
5. Your content
You keep ownership of the photos, entries and messages you add. You give us permission to store, process and transmit them, including sending them to our service providers as described in the Privacy Policy, only to operate and improve the service for you. This permission ends when you delete the content or your account, except for copies in backups that expire on their normal schedule.
6. Our service
We provide Chou "as is" and "as available". We may change, suspend or stop features, and the service may be unavailable at times, including when third-party providers are down. The app, its design and its software belong to us or our licensors; these terms don't give you rights to them beyond using the app.
7. Termination
You can stop using Chou and delete your account at any time in Stats → Daily targets (target icon, top right) → Delete account. We may suspend or close accounts that break these terms or put the service or other users at risk. Sections that by their nature should survive (such as disclaimers, limits of liability and governing law) survive termination.
8. Disclaimers
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We don't warrant that nutrition values, food identification, patterns or chat replies are accurate or complete.
9. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, health outcomes arising from reliance on the app, or lost profits. Our total liability for any claim relating to Chou is limited to the greater of the amount you paid us in the 12 months before the claim or USD 50. Some jurisdictions don't allow some of these limits, so they may not apply to you. Nothing in these terms limits rights you have as a consumer that cannot be limited by contract.
10. Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law rules. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live.
11. App stores
If you downloaded Chou from the Apple App Store or Google Play, these terms are between you and us, not Apple or Google, who are not responsible for the app. Apple and its subsidiaries are third-party beneficiaries of these terms for apps obtained from the App Store and may enforce them. Your use must also follow the store's own terms.
12. Changes
We may update these terms. We'll change the effective date above and, for material changes, tell you in the app or by email before they take effect. If you keep using Chou after that, you accept the updated terms.
